簡介:碩士學位論文中國稅務代理問題與對策探求STUDYONTHETAXAGENCYOFCHINA姓名學科專業(yè)研究方向指導教師完成時間張云華政治經濟學稅務代理李光龍教授2005年11月中國稅務代理問題與對策探求我國稅務代理從上個世紀80年代開始試點到90年代的確立和治理整頓,幾經風雨沉浮,產生了一定績效,但存在不少問題,集中表現為代理需求不足,RLLI好不賣座。原因在于第一,思想認識缺陷,對稅務代理認識不夠。第二,以流轉稅為主的稅制模式簡單易行、執(zhí)法環(huán)境不完善、納稅主體市場化程度不高等原因,使得納稅人納稅成本和風險不高;第三,由于稅務代理人業(yè)務素質水平低下,無法提供廣泛的、優(yōu)質的服務,致使納稅人代理優(yōu)勢表現不明顯。而由于稅務代理制度不完善、規(guī)范稅務代理主體供給缺陷以及行業(yè)監(jiān)管制度的不健全,使納稅人委托稅務代理的各項成本很高。因此,稅務代理優(yōu)勢大于稅務代理成本的1I等式難以成立,稅務代理市場行將萎縮。第4章“我國稅務代理發(fā)展現狀與問題分析”對上述問題與原因進行較為詳細剖析,是文章暈點部分。文章前面所有理論和實證分析的落腳點在于第5章,即“推進我國稅務代理業(yè)加快發(fā)展的對策”。針對我國存在的代理需求不足等原因,結合各國成功經驗,從稅法完善、稅制優(yōu)化、嚴格執(zhí)法和提升納稅主體市場化程度方而,努力創(chuàng)造稅務代理外部條件;建立完善和規(guī)范稅務代理供給市場以降低納稅人代理成本,突出代理優(yōu)勢,產生代理需求;大力宣傳,解決思想認識問題,轉換觀念,以此推動稅務代理業(yè)繁榮發(fā)展。關鍵詞代理、稅務代理、代理優(yōu)勢

簡介:浙江大學博士學位論文信貸契約軟約束研究兼論我國經濟轉軌時期信貸市場的多重委托代理關系姓名虞迪鋒申請學位級別博士專業(yè)政治經濟學指導教師宋玉華20060601角度論證假說。第四章從銀企委托代理關系中的交易成本、交易方式和契約選擇角度,通過對交易成本加以界定和劃分,探討信貸契約的交易成本、交易方式和契約選擇之間的關系,在此基礎上,論證了我國經濟轉軌時期關系型信貸契約存在的原因及由此導致的軟約束。第五章從銀企委托代理關系中的控制權角度分析了我國商業(yè)銀行對企業(yè)缺乏控制權配置的缺損及由此導致的軟約束問題,認為我國商業(yè)銀行對企業(yè)控制權配置的缺損,是由于缺乏控制權的配置和在此基礎上的制衡。并且,在比較美日兩種企業(yè)控制權配置模式的基礎上,提出了我國銀企控制權配置的有效模式,并對優(yōu)化我國商業(yè)銀行對企業(yè)控制權配置提出了對策建議。第六章從銀企委托代理關系中的信息不對稱及其治理的角度來論證假說。運用信貸合約的逆向選擇與信息甄別機制理論,論證了影響我國銀企信貸契約軟約束的重要原因是信息甄別機制的匱乏。經濟轉軌時期的一些特殊因素使得信貸抵押擔保等都難以成為企業(yè)對銀行發(fā)出的有信息價值的信號,制度上的規(guī)定也使得信貸利率失去信號的作用,從而信貸博弈難以達成銀行所期望的分離均衡。而要完善信息甄別機制,必須綜合運用多種甄別信號。第二層面第七章從道德風險角度,主要是從銀行內外部委托代理治理的角度來論證假說。信貸活動的道德風險行為主要是現有權利和責任模糊的委托代理鏈條,其中政府與銀行、銀行內部二個層面的委托代理關系中均存在責任主體缺位問題。導致這種責任主體承擔缺位原因,既有現實經濟的制度導致的預算軟約束因素,又與商業(yè)銀行內部激勵約束機制不健全高度相關。第三層面第八章主要從信貸契約履行的角度進一步論證假說,主要在銀行與政府這一委托代理層面上展開分析。在對西方現代契約理論及有關契約履行機制進行系統(tǒng)論述的基礎上,分析了我國信貸契約履約的障礙,認為我國經濟轉軌時期信貸契約履約軟約束的主要原因是政府的介入,信用管理制度和法律制度的不健全,以及自我履行機制的扭曲和債權人清算要挾的不可信。第四部分第九章提出硬化信貸契約軟約束的政策建議。針對政府、銀行、企業(yè)三重委托代理關系及其治理沖突問題,從完善內外部治理機制以及健全信息披露制度等多種途徑入手,建立市場化的金融硬約束環(huán)境,實現信貸契約從軟約束向硬約束關系的平穩(wěn)過渡。關鍵詞信貸契約多重委托代理契約軟約束
